Law Term Paper Example | Topics and Well Written Essays - 1250 words
Law - Term Paper Example Consequently, copyright law functions more as a tool to defend creators and not as a system promoting innovation and creativity. Indirect infringement in the US comes under vicarious liability (Shapiro, Bernstein v. HL Green 326 F.2d 304 (2nd Cir. 1963)) and/or contributory liability (Sony Corp. v. Universal City Studios, 464 U.S. 417 (1984)). Where as, in Canada indirect infringement is known as secondary infringement. At the same time with regard to "fair use" doctrine this doctrine can be used in the US in a very broad sense than in Canada. This means that the provisions of fair use are more liberally interpreted in the US than they are in Canada. This is the background of the discussion for this paper. The most important factor of copyright law is linked to the public interest. Copyright law actually protects and for ever tries to equalize the requirement for motivators for creativeness and the requirement to allow society to approach works created (B Kaplan, 1967; P Goldstein, 1970; R C Denicola, 1979; M J Radin, 1982; D Baird, 1983 and I E Novos and M Waldman, 1984). Widening the security rendered by copyright furnishes better incentives for generators, but constricts the public area, that is, the general cultural resources to which the public has contact. Bringing in the right balance linking adequate incentives for originality and limiting the public domain has at all times been, and yet is, one of the major tests of copyright law. The Canadian and US laws look very different on their face as one anticipates different consequences in both the countries with regard to infringement of copyright laws. This is true only to a certain extent. Therefore, when a report is published by the Canadian government or a group which is the agent of the crown can claim copyright of the report in Canada (Dableh v. Ontario Hydro, 1993)i. Whereas the same report, if published by any arm of the US federal government, cannot claim

Affecting Change Research Paper Example | Topics and Well Written Essays - 1750 words
Affecting Change - Research Paper Example This is particularly so as a result of the high volume of reports and referrals, together with budget cuts (Waldfogel, 1998). As a result, there are many instances in which some children at high risk of maltreatment are not identified and in other cases, too much attention is turned toward children who are not at a genuine risk of abuse or neglect (Waldfogel, 1998). It has been widely suggested that community partnerships can improve CPS responsiveness and foster an environment capable of ensuring that children are safe (France & Utting, 2005). This paper investigates the feasibility of community partnerships as a method of improving the current CPS system. The first part of this paper details and analyzes the current CPS system. The second part of this paper will analyze the concept of community partnerships and demonstrates how it can improve the current CPS system and in turn improve the safety of children. Munro (2005) describes the current CPS system in Western ideology as similar to that of the functioning of a nuclear power plant. According to Munro (2005), like a nuclear power plant, the CPS system is focused on the prevention of disaster, injury and death. While this is not necessarily a bad thing, it focuses far too much attention on prevention rather than cure. However, the main problem is attributed to the fact that when errors are made and disaster, injury of death occurs, quite often humans rather than the system are blamed for the error. This focuses attention on personnel changes rather than systematic changes (Munro, 2005). A review of the literature suggests that the current CPS system is built around a rigid ââ¬Å"investigative response to child maltreatment reportsâ⬠, is ââ¬Å"adversarialâ⬠in nature and does not does not take a holistic approach to meeting the needs of the family (US Department of Health and Human Services, 2009, p. 1). A national survey of CPS conducted by the US Department of Health and Human

Evidence relating to family issue Essay Example | Topics and Well Written Essays - 1250 words
Evidence relating to family issue - Essay Example The understanding of major concerns impinging upon these families: interactions or relationships with healthcare providers and social support are improved when they are defined as family weaknesses, resources, and evaluation within the perspective of the family systems theory. Of these models, family evaluation emphasises the essence of observing the family from the point of view of the family itself (Bengston, Acock, Allen, Dilworth-Anderson, & Klein, 2004). This approach will be used in the assessment of the single-mother and her family as well as the potential stress she may experience due to the demands of motherhood, work life and care giving. This particular assessment will be used in identifying the best strategies for coping and managing time that she and her family can apply. Involvement in the treatment procedure could be difficult for healthcare providers and families for various causes. Nurses supporting adults with dementia showed dissatisfaction working with elderly caregivers and sensed that these caregivers were more doubtful than others they assisted (Smith, Coleman & Bradshaw, 2002). Furthermore, nurses observed parents were opposed to adjustments when it was, in the belief of the nurse, are for the benefit of the client (Hanson, 2001). The single-mother, being in her early forties and being the primary caregiver of her father, may have problems dealing with support service providers. Furthermore, being a single-parent to three children she may resist proposed family adjustment strategies from the nurse/s. She will more likely refuse to change her coping strategies and time management because these adjustments mean adjustments in the entire family systems and processes. In addition to that, her mother refuses to acquire healthcare support for her father for the reason that her mother believes that it is her responsibility to take care of her

Answer the question Assignment Example | Topics and Well Written Essays - 3500 words
Answer the question - Assignment Example Lastly, depending on the time of the day, those students who will get interviewed quite possibly will have no classes; hence have the free time to walk around. The result of this particular study may get generalized in some populations, the first one being those that exhibit high levels of the eternal validity of the study (Fraenkel &Wallen , 2009). Secondly, the population should produce a sample nature as well as the environmental conditions that prove for generalization to get made. The particular sample of study must also represent the population of interest, the sample has to be relatively large so that the usefulness of the findings become unlimited. If these particular two communities meet the conditions for generalization, then the researcher can conclude by saying that playing soft classical music increases the ability of scholars in understanding arithmetic studies. At times, a researcher may feel not interested to generalize the result of a study, and this mostly happens when the particular samples used fails to show the external validity of the study. It may also occur in those samples used shows high levels of relevancy about the characteristics of the population under study. In some cases, the samples may fail to demonstrate some of the essential part of the population under study as well as the representation of the relevant variables. Finally, when the sample size is reasonably small or narrowly defined, the generalization from this particular study becomes limited. It is true, to some extent, that the larger a sample, the more justified a researcher is generalizing from it to a population. This can only be more valid if the researcher takes into account the issue of timing and proximity, among other factors depending on the given case study (Fraenkel &Wallen , 2009). The larger sample always tends to take into consideration on most of the essential and other relevant characteristics of the entire population,

Self Management and Personal Effectiveness Essay
Self Management and Personal Effectiveness - Essay Example SWOT analysis: - Strengths, The things I am good at are 1) my I.T. Hardware skills, 2) My Language and communication skills and 3) my outspokenness and ability to move with people without shyness or inhibitions. Weakness. My inability to cope with work load at home as described in appendix(2) I have arrived at these weaknesses by asking my self the following questions s suggested in SWOT analysis technique. Such as, the Things I can improve up on, what can I avoid What are the things that people around me see as my weaknesses which I am not able to perceive My mentor Florence should be complimented for having identified my weaknesses which I had been not very serious about. Opportunities I have just begun my career and future career opportunities are unlimited. Threats Constant changes in the computer technology and the need to keep my self always updated. Further, harassment at work place from colleagues rather than from my boss. In further self-analysis, I took temperament sorter test and I have found my self to be of "Guardian". (keirsey.com). True to Guardian character of a natural protector, I perform too much of work part of which I volunteer just to help even my hatred-spewing colleagues true to my catholic spirit and also help my understanding boss who seems to be helpless at my position.. I am unable to say no to those people even at the height of my own workload. Please refer to appendix 3 for more details of Guardian. Locus of control test (appendix 4) which would enable me to find my outcomes of my actions depend on what I do (internal control orientation) or on events outside my personal control (external control orientation). My attribution style determines which forces I hold responsible for my successes and failures. Both locus of control and attribution styles have a bearing on my motivation, expectation, self esteem, risk taking behaviour, and even on the actual outcome of my actions. I have to develop my ability to live with pressure which is a prerequisite for a long career for which this locus of control test has provided me insight into my ability. I have scored what can be called Internal locus of control meaning that I am capable of taking control of the situations. Except for the workplace problem which if my management does not solve for me, then the harassment for religious grounds is my external locus of control and therefore I should decide accordingly i.e to even leave my job. T he rest of the problems are certainly within my control if only I am able to set my priorities and deal with my time wasting chores effectively and also learn to say 'no' to others. Perhaps I can ask for a transfer to work in a group without religious bias and may be I will soon get promotion as a result of exemplary performance due to my improved internal locus of control. The most obvious weakness in me is my inability to strike a balance between home and office which I now realise calls for time management skills. The 80:20 rule known as Pareto principle advocated by Covey (1992) says that 80% of unfocussed efforts generate only 20% of results. The ratio is not always 80:20 but it has become the norm. This implies that I should have a realistic plan for what I want to achieve within the next
